Past NYPD experience with video cameras shows pattern of editing to thwart accountability for misconduct

The NYPD have a history of manipulating their own videos, as a 2004 City Council report found

A special report from the City Council Committee on Governmental Operations showed that, “In the aftermath of the numerous confrontations between demonstrators and police at the February 15th rally the Civilian Complaint Review Board (“CCRB”) investigated 54 complaints containing 114 allegations of misconduct by police officers.” Among the NYPD violations the report found was that the police department’s Technical Assistance Response Unit provided to CCRB heavily edited videos in a deliberate effort to disguise the police officers who committed violations. “Thus, many complaints were dropped where the officers went unidentified.” This is how the NYPD operated when it knew its actions were not going to be supervised or subjected to any accountability.

How can CCRB, much less the public, have faith and trust in NYPD officers maintaining control over their own body cameras ?

According to news reports, the New York Police Department are considering a pilot program to video record police officers on duty. NYPD Commissioner William Bratton told reporters that the pilot program under consideration would allow police officers to control the activation of their own body cameras, raising concerns amongst police reform activists and civil libertarians.

How can the press honestly report that this is a "pilot program," and that a police department program aiming to film their own operations is about to be created ? The NYPD have been filming their own operations for years. What is more, many charge that the NYPD make video recordings of activists' peaceful and lawful political activities, which constitutes violations of activists Constitutional, civil rights, civil liberties, and other rights. Some of these records also violate a court order known as the Handschu Agreement. The proposal to use body cameras has been criticised by civil libertarian advocates, who question the police motivations to record innocent citizens. With the NYPD's experience and technology, they have already demonstrated a track record of how they mishandle their own video records and of the recordings of innocent New Yorkers. Based on a report about police misconduct published over a decade ago by the New York City Council, it has been shown that the NYPD cannot be trusted to record themselves, because, in the past, the NYPD have deliberately edited videos of their own performance with the blatant intention to circumvent accountability and oversight for their own misconduct, brutality, and other violations of police procedures.

Some police reform activists believe that recording police while they are on duty is a good reform, but not all police reform activists agree. Others take share the same concerns of civil libertarians. However, if there is a way to fully address the concerns of civil libertarians, for the use of body cameras to work, police officers should not be able to control, limit, turn on, or turn off their body cameras in any way. For body cameras to work, both the audio and video should be recorded during the entire duration of police officers' shifts. This information should be stored for as many years as it would be needed to facilitate the frequent federal, state, and municipal investigations into police misconduct. However, it remains to be seen whether the concerns of civil libertarians can truly be addressed. Over the decades, the NYPD have created so much distrust in New York City. The proposal to use body cameras is already polarising some in the police reform activist community. Based on the lack of trust and faith between the NYPD and citizens, it's difficult to tell whether everybody's concerns can be fully addressed.

In New York, the state Attorney General has lost control over his wayward District Attorneys. Now, the State Legislature wants to appoint a disciplinary commission to review the corrupt acts of the state's "Dirty D.A.'s"

The New York State legislature, that swamp of corruption, is hoping to create an independent commission to investigate the prosecutorial misconduct of New York’s state prosecutors. The commission members would be able to recommend disciplinary actions against prosecutors engaging in "improper activity or whose performance displays a degree of incompetence not suited for the office," The Brooklyn Paper reported.

The possibility that the state's district attorneys have become corrupt is too much for the state's attorney general, Eric Schneiderman, to handle. The only way hot political corruption cases like this can be handled is to outsource it to an incompetent commission, which Gov. Andrew Cuomo can then disband if the political heat becomes too much to bear, like what he did with the do-nothing Moreland Commission.

The scandal with Brooklyn D.A. Hynes is only coming up now, because Manhattan U.S. Attorney Preet Bharara is investigating JCOPE ethics complaints and Moreland Commission corruption files. Were it not for Mr. Bharara's ongoing campaign to clean up government corruption, the city's lazy Department of Investigations would not have investigated any of the corrupt district attorneys in New York's five boroughs, much less D.A. Hynes. Naturally, there are rumors being shared amonst activists that the DOI probe into former D.A. Hynes may have been politically-motivated, like all the other take-downs in New York City. Of course, nothing is going to happen in respect of this proposed district attorney investigation commission, unless Assembly Speaker Sheldon Silver blesses this commission, which voters know he won't, because Speaker Silver has a long history of enabling corruption all across New York state. But some New York City-based bloggers and activists privately wonder if just the fear of the idea of this commission will scare the crap out of some corrupt local district attorneys, like Manhattan D.A. Cy Vance, who many good government reform activists believe avoids prosecuting political corruption cases.

Besides Mr. Vance, the new Brooklyn district attorney, Ken Thompson, also avoids thorny political cases. For example, Mr. Thompson failed to examine the slimy circumstances of how one of the mayor's loyal political supporters was allowed to basically get out jail for free. The long-time Queens district attorney, Richard Brown, refused to find any wrong-doing when the New York Police Department kidnapped and held prisoner the whistleblower Adrian Schoolcraft in the psychiatric ward of a Queens hospital.

In New York, whenever political or law enforcement corruption becomes so bad, the only way the corrupt justice system handles it is by outsourcing the investigation to an independent commission or to an independent prosecutor, because the district attorney, attorney general, or federal prosecutor with normal jurisdiction doesn't want the political blowback from these kinds of investigations. Look at how the Staten Island district attorney appointed a special prosecutor to investigate the corrupt Working Families Party ; the Staten Island D.A. didn't want to touch that investigation. These kinds of cases are TOO HOT for the normal investigators to handle. Investigators race to outsource probes to others, who can either afford to take the political heat or who are too stupid to know the difference. But if only voters could see why these investigations have to get outsourced, then that would show voters how the justice system truly has become corrupt, because there should be no reason why there should be a "tale of two justice systems" for political corruption.

Meanwhile, as Albany considers more and more layers of supervision over the state's crumbling law enforcement apparatus, it was reported this week that Mayor Bill de Blasio has yet to appoint a chair to the city's Civilian Complaint Review Board, a do-nothing oversight panel meant to push papers about in respect of civilian complaints against the NYPD, in spite of the fact that the NYPD appear to be openly engaging in racing profiling in respect of the low-level marijuana arrests that police are making under the de Blasio administration.

Quinn uses NYPD to Block Protesters (Again) (No Surprise)

During a peaceful and legal protest against the mayoral campaign of New York City Council Speaker Christine Quinn, NYPD officers used physical force to attempt to move protesters off of a wide public sidewalk and onto the other side of the street. When we refused and maintained our right to free assembly, they used the bodies to block us from distributing leaflets.

Are the NYPD blocking anti-Quinn protesters again, because she has agreed to retain Ray Kelly as Police Commissioner ?

Speaker Quinn has become emboldened ever since she overturned term limits, got away with using millions of dollars of taxpayer dollars in an illegal slush fund, weakened the campaign finance laws, and used major real estate projects to extract campaign donations from developers in a system that many describe as a "pay-to-play" culture. Now, she is using the NYPD as her own private army. The impression that Mayor Mike Bloomberg has influenced her is an understatement.

Because of her record of corruption, activists are basically waiting for Speaker Quinn to be caught in more scandals, before the mayoral election this year.

The protest last night took place at a "housing debate" in Brooklyn.

Bloomberg, Quinn, NYPD, Winski Destroy OWS, Democratic Social Movements, Lawful Activism

Systematic suppression of the Constitutional rights of lawful political activities of activists, politicians, and journalists to observe police actions against Occupy Wall Street protesters.

Deputy Inspector Edward J. Winski, on orders from City Hall : Mayor Michael Bloomberg and approval (either tacit or express) by City Council Speaker Christine Quinn engages in use of police force, misuse of authority, no professional, lack of respect and courtesy, not to mention abridgment of the Constitutionally-protected Freedoms of Speech and Assembly, to thwart the lawful political activities of citizens. Note how police officers selectively pick activists from within a crowd and use force to make false arrests. One person also provides testimony that a legal observer is arrested by the NYPD.

In this video, some activists deliver first-hand witness accounts of Deputy Inspector Winski misusing his official authority for the sole purpose of interfering, thwarting, and destroying the rights of these activists. The intent of Deputy Inspector Winski can solely be to destroy any chance activists have to peacefully and lawfully assemble and express themselves.

According to the video's description on YouTube, the above video was filmed on September 15, 2012 from 5 p.m. to 9 p.m., and it shows "some of the major events," which took place during livestreamer Luke Rudkowski's live broadcast at the "Occupy Wall Street #S15 action."

And no amount of independent monitoring, oversight, community regulation, not even the existence of the Civilian Complaint Review Board or Internal Affairs investigations, can correct the abuse of authority when it is ordered by and/or is carried out with the tacit or express approval of the politicians, who give orders to NYPD. Here is past evidence about how Deputy Inspector Winksi and the NYPD have misused their authority against peaceful and lawful #OWS activists, I'm sure this can't be the rest of it.

To change the system, you have to join community organising efforts to challenge the oppressive conditions, which violate citizens' rights, and this includes taking action to vote out of office the politicians, who give these orders to NYPD.
