Schneiderman Scrambling To Arrest Corrupted Officials Before Federal Prosecutor Hands Down Embarrassing Grand Jury Indictments [UPDATED]

Attorney General Eric Schneiderman Finally Gets Around To Arresting Councilmember Ruben Wills On Investigation That Is Over Two Years Old

With federal prosecutors hot on a corruption crackdown across New York state, the state's attorney general, Eric Schneiderman, today arrested New York City Councilmember Ruben Wills on a charge of misusing some of the proceeds of a $33,000 state grant to New York 4 Life, a charity the councilmember managed.

The $33,000 grant to Councilmember Wills' charity was sponsored by former New York State Sen. Shirley Huntley in 2008. Two years ago, Councilmember Wills' charity refused to fully comply with a subpoena issued by the state's top prosecutor's office, forcing state prosecutors to file a court motion to compel the charity to comply. After that, the state's case went dormant. During this time, Gov. Andrew Cuomo formed an anti-corruption panel to great fanfare, but the governor ditched the panel as soon as it appeared that the panel would investigate the governor's own questionable political supporters. Recently, the outrage by good government groups and government reform activists reached such a fevered pitch at the government's inept prosecution of corruption that the top federal prosecutor in Manhattan, Preet Bharara, took over the corruption investigations of the now-defunct anti-corruption panel, known as a Moreland Commission. In the time since the feds took over, Mr. Bharara has empaneled a grand jury, obtaining subpoenas for corruption records. As government reform activists await possible grand jury indictments, all of a sudden the state's attorney general has begun to look busy. One fruit from Mr. Schneiderman's scurrying efforts was today's arrest of Councilmember Wills.

But Councilmember Wills' corruption arrest is complicated by many factors. One of the publicly-elected officials, who State Sen. Shirley Huntley was asked to wiretap and photograph as part of an undercover FBI sting operation on political corruption, was Councilmember Wills, according to Politicker. Prior to that, former City Council Speaker Christine Quinn endorsed Councilmember Wills for re-election one day after he had appeared in court to face a misdemeanor stealing charge. Councilmember Wills earned his incumbency on the City Council in a special election in southeast Queens in 2010 to succeed Thomas White, who died in August in 2010, and Councilmember Wills was re-elected in 2011 to continue to serve the remainder of White’s four-year term. Councilmember Wills later appeared in court in March 2011 on charges in connection with a 1996 incident. He was accused of damaging a wall and removing a fan and track lighting at a downtown business.

After Councilmember Wills' March 2011 court appearance, Speaker Quinn defended Councilmember Wills. "I'm extraordinarily proud of my City Council and proud of the members that I get to serve with every day on behalf of the people of the City of New York," she told The New York Daily News at the time.

In spite of Councilmember Wills' troubles, Speaker Quinn had awarded Councilmember Wills $584,000 in discretionary funding in the city's 2012 budget.

That Councilmember Wills is being singled out in the attorney general's sudden efforts to catch up with the state's long backlog of corruption investigations is troublesome. As has been noted by others, it can sometimes appear that state and federal prosecutors seem to obsess with the petty crimes of minority politicians, which conveniently allows larger corruption scandals to go uninvestigated and unprosecuted. It doesn't help when the media portrays the political corruption problem as only being isolated to Queens, for example. Corruption is a bigger problem, and the bigger corruption scandals rarely receive the kind of scrutiny as petty crimes. Councilmember Wills was arrested for allegedly misusing the proceeds of a $33,000 state grant. Former Sen. Huntley is serving a one-year prison sentence in connection with the misuse of $80,000 in tax payer money. Meanwhile, there's still no update on whatever happened to the corruption probe into how Aqueduct Entertainment Group landed a multibillion-dollar casino contract. But in that AEG probe, two more black leaders, State Sens. John Sampson and Malcolm Smith, appear to be targets. Each of Sens. Sampson and Smith are also being investigated in connection with still yet other corruption charges. Another possible corruption scandal in Queens, a questionable $20 million construction project by the Queens Public Library, will probably drag on for years before any indictments or arrests are made. State Sen. Jose Peralta, another minority leader from Queens, is the subject of a possible corruption investigation that is almost five years old involving over $500,000 in taxpayer money that was funneled to Corona-Elmhurst Center for Economic Development, a dormant non-profit organization. No arrest or indictment has yet to be made in connection with state Sen. Peralta's non-profit. Moreover, there's also been no update into an alleged investigation into the awarding in January 2010 of a $50 million voting machine contract to Election Systems & Software by New York City election officials. The new voting machines turned out to be an embarrassment to city officials, when it was revealed that the new machines would be unable to timely tally votes for the primary and general elections, even though they are "electronic" machines, forcing New York City elections officials to drag out clunky voting booths that work with levers, pulleys, and wheels in the last mayoral primary election. Even after the $2 billion fiasco that is the ECTP 911 emergency call EMS system that keeps crashing over and over -- and over again -- there's still no investigation into cost over-runs, failures, or other possible wrong-doing. Also pending is the outcome of the city's investigation into the corrupt campaign spending by Super PAC's administered by one lobbying firm, The Advance Group. And all there is, is silence about the other corrupt Super PAC's from last year's municipal elections.

While the attorney general follows up on the missing $33,000 that Councilmember Wills cannot fully explain, there are millions and billions of taxpayer dollars in outstanding corruption investigations, and allegations that may call into question the integrity of our entire election system, that appear to be going cold. This pile-up of corruption cases proves that city and state prosecutors are inept at fully investigating political corruption. Instead, state and local prosecutors just looked the other way, and the incidence of corruption just kept piling on up until nothing less than a dedicated Moreland Commission would be needed to flush all this corruption out of the system. But since Gov. Cuomo scuttled the Moreland Commission, now the task of prosecuting all this corruption lands on the laps of the U.S Attorney's Office. Indeed, federal prosecutors received the files of about two dozen possible investigations from the now-defunct Moreland Commission that city and state investigators never got around to worrying about before now. When the governor first formed the Moreland Commission, the press never asked why lazy city and state prosecutors had allowed corruption to grow to become a stage 4 cancer on our government. Once the feds excise this cancer of corruption from our body of government, will we have enough good officials left to right this ship ? After all this is over, one of the first things voters should demand is for the elected officials to determine why did the state's attorney general and all of the district attorneys let corruption become so out-of-control in New York in the first place. Prosecutors should also determine the legality of allowing government officials to subvert the conduct of the public's business by elected officials, who use private e-mail services to hide the government's official work from the reach of sunshine laws, a tactic embraced by Gov. Cuomo. The shady use of private e-mail accounts to subvert the reach of freedom of information laws or the discovery process of litigation is a practise typical on Wall Street and their big money law firms. Now, Gov. Cuomo has apparently rolled out this shadowy machination to New York state government. Gov. Cuomo's pattern of political subterfuge may have contributed to the failure of the Moreland Commission to refer any criminal case for prosecution before its disbanding, and the appearance of sabotage is said to be being the focus of federal prosecutors. Government reform activists privately hope that Gov. Cuomo's interference with the doomed Moreland Commission can meet the legal definition of obstruction of justice, opening the door to a political pressure point to force government reforms, if not at least to give federal prosecutors additional evidence to hand down indictments against more crooked politicians, who are responsible for enabling political corruption in New York state government.

In the meantime, Speaker Quinn's successor, Councilmember Melissa Mark-Viverito has indicated that she will not allow Councilmember Wills to decide the fate of his slice of this year's City Council slush funds. Instead, her office will decide where his allocation of the discretionary funding will go, in consultation with the chair of the Queens Councilmembers' delegation. At all costs, the Council Speaker's office is intent on keeping its councilmember slush fund. Even though many officials have been charged with fraud in connection with the misuse of the City Council's discretionary funds, the corrupted elected officials are too addicted to the power that comes from doling out these grants.

Last year, former Council Speaker Quinn approved the disbursement of $3.2 million in member items requested by Councilmember Dan Halloran, even though the councilmember had been charged in a conspiracy and bribery scheme relating to his member items. In the criminal complaint against him, Councilmember Halloran suggested to an undercover FBI agent that Councilmember Halloran could increase the size of the discretionary funds he was using as a bribe by calling in favours from other councilmembers. For all the corruption that the City Council did to hide the speaker's multimillion-dollar slush fund, former Speaker Quinn herself was never prosecuted.

With millions and billions in taxpayer dollars at stake in uninvestigated political corruption, law enforcement under the de Blasio administration continues to focus on NYPD Police Commissioner William Bratton's obsession with his "broken windows theory" of policing. Instead of focusing on the "criminal networks" of political corruption and corporate corruption, law enforcement instead over-police the poor and people of color, targeting them, amongst other places, on public transportation systems of subways and buses, a regressive move that may violate the Civil Rights Act.

Barfing into bags, voters face a moment of truth about Democratic Party incumbents

Democratic Party bouncers give voters no choice but to re-elect Gov. Cuomo

"Every place is not Greenwich Village," said Assemblyman Keith Wright, who is also chair of the state's Democratic Party, referring to a lack of support in the rest of New York State as an excuse for why Gov. Andrew Cuomo has failed to roll out any liberal reforms.

The ironic thing is that everybody knows where there are concentrations of liberal thought. Gentrification does a very good job of corroding these neighborhoods to disperse like-minded individuals. Dissent almost doesn't exist anymore, and nobody respects autonomy. The last few hold-outs are haggard, and true solidarity has all but shriveled up. After the number that real estate developers have done to the Village, especially the harvesting of St. Vincent's Hospital before the poor corpse had even died, isn't it more true that Mr. Wright's quote should be, "Greenwich Village has become like every place ?"

The hopeful thought would be that activists would realize that going back to fighting for single issues is the fastest way for everybody to lose. Thinking small is a losing way to think. Caring about our own pet issues makes us unprincipled, because it means we are only in this for ourselves and not for all of us. This pressure is real. After all the evidence of corruption coinciding with the Cuomo administration, look at how the only ones practising discipline are Democratic Party "leaders," who want your votes in exchange for more cheap-ass talk. Somebody complained yesterday that there is nobody, who can run against Gov. Cuomo, but that is a lie, because there are other people running against Gov. Cuomo. But people seem to be more impressed with the celebrity of a candidate than with casting a vote for an alternative that involves the slightest bit of taking a chance on a new face. Keeping voters in this place of fear works nicely for incumbents.

If people fail to achieve solidarity and fail to take a chance on someone new, then the only winners here will be Gov. Cuomo, Democratic Party bouncers, and their permanent government operative insiders, who double as big business lobbyists. It's enough to make one barf.

FBI agents seeking to determine if NY-CLASS donors hid Super PAC donations in coordinated effort to influence mayoral election

The NYC Is Not for Sale Super PAC TV attack blitz last year against former Council Speaker Christine Quinn brought to the fore years of grassroots discontent and organizing against Speaker Quinn. But FBI agents are investigating whether the hundreds of thousands of Super PAC expenditures were being coordinated behind the scenes by the de Blasio campaign or its surrogates, The New York Daily News reported.

According to federal law, it is illegal for Super PAC's to coordinate their efforts with the official campaigns of political candidates. But on May 21, 2013, the attorney Jay Eisenhofer, who was Mayor de Blasio's largest campaign bundler, gave $50,000 to NY-CLASS, the animal rights group leading the charge to ban horse-drawn carriage. Ten days later, on May 31, NY-CLASS gave an equal amount -- $50,000, to the NYC Is Not For Sale Super PAC. On June 1, NY-CLASS received another large donation, this time for $175,000. It came from UNITE HERE!-- a labor union formerly headed by John Wilhelm, the mayor's cousin. Two days after that, on June 3, NY-CLASS sent the same amount, $175,000, to the NYC Is Not For Sale Super PAC, The New York Daily News reported.

If Mr. Eisenhofer and UNITE HERE! contributed directly to the NYC Is Not For Sale Super PAC, their involvement would have been made public within weeks because of campaign finance disclosure rules, but because they funneled their contributions through NY-CLASS, Mr. Wilhelm and Mr. Eisenhofer were cloaked in anonymity for months. The trigger for NY-CLASS to disclose their donors did not take place until NY-CLASS began its own campaign expenditures, an event that occurred on Sept. 7, three days before the Sept. 10 mayoral primary, The New York Daily News reported. NY-CLASS finally disclosed the contributions on Sept. 17, 10 days after the primary. The coordinated campaign contributions were first reported by Crain’s New York Business.

Confronted last year about the NYC Is Not For Sale campaign, then candidate de Blasio initially defended NYC Is Not For Sale's attack ads, saying, "People decided to speak out, and that's their legal right. But the fact is in our system, everything can and will be disclosed, and that's what the people require," although, contrary to then candidate de Blasio, the Super PAC got into trouble for failing to fully disclose its activities, as "the people require." At the time, Mr. de Blasio added that he'd be open to later reforming campaign finance laws (presumably after NYC Is Not For Sale sank former Speaker Quinn's mayoral campaign). "The important thing is to respect the fact that we may not like the way the law is, but it's the law. I certainly will put energy going forward into trying to further reform the campaign finance system, but so long as the law is the law, people will make choices within it. That is their right, but I will certainly never ask anyone to engage in such behavior." But so far, the mayor has betrayed his campaign promise to reform the loose campaign finance laws that allow Super PAC's to game elections. Furthermore, former Speaker Quinn has appeared to be milking the NY-CLASS scandal to portray herself as a victim of shady campaign finances ; meanwhile, she has a long record of political corruption.

If Mayor de Blasio was a true progressive, he would under take real reforms, like banning all private campaign donations in municipal elections, ending the appointment of municipal campaign finance regulators by politicians, and instituting newer, tougher regulations of campaign consultants/lobbyists. But perhaps Mayor de Blasio needs to protect the status quo of the broken campaign system. Judging by his 2013 campaign strategy, his 2017 reëlection campaign may be predicated on such.

Separate from violating campaign finance laws, the roles of NYC Is Not For Sale, NY-CLASS, and the lobbying firm advising them both -- The Advance Group -- had damaging effects on the opportunity for reform in a post-Quinn municipal government. Because of the independent campaign expenditures that nearly totaled $2 million, the influence of NY-CLASS perverted the ability of other issue reformers from being taken seriously by the media. Witness how the media accepted the controversial appointment of William Bratton as police commissioner, even though he still supports unconstitutional tactics, such as stop-and-frisk and the broken windows theory of policing, which unfairly targets low-income communities and people of color -- but does nothing to combat the white collar crimes by political operatives or by Wall Street. Further, NY-CLASS misappropriated the grassroots work by reform activists, including tenants' rights activists like John Fisher, police reform activists, QUILTBAG civil rights activists, and St. Vincent's Hospital activists, who each had separately and collectively spent years organizing to vote the former Council Speaker Quinn out of office. There was even a serialized book, recounting former Council Speaker Quinn's long record of community and political betrayals.

Casting a further pall on Mayor de Blasio's young administration is the outsized influence of lobbyists in City Hall, coordinating 501(c)(4) political campaign spending by loyal political operatives for his universal pre-kinder initiative with City Hall, his failure to reform the city's campaign finance system, and the reluctance by his administration to answer a FOIL request for records pertaining to possible obstruction of justice in the mayor's efforts to bust one of his campaign supports out of jail.

Former Met Council Leader, Wm. Rapfogel, Enters Guilty Plea in Corruption Case

Following guilty plea convictions of Rapfogel and Cohen, Attorney General's investigation into public corruption continues.

William Rapfogel, the former leader of the Metropolitan Council on Jewish Poverty, pled guilty today in state court to charges of "grand larceny, money laundering, tax fraud," and filing false documents with the city's campaign finance regulatory authority, the Campaign Finance Board, The New York Times reported today, adding that the guilty plea followed Mr. Rapfogel's arrest last September on charges of "grand larceny, money laundering, conspiracy and other crimes in a criminal complaint filed by the state attorney general, Eric T. Schneiderman."

Mr. Rapfogel's predecessor, David Cohen, entered into his own guilty pleas to charges of grand larceny and conspiracy. Both men laundered some of their illicit gains into campaign contributions with the intention of manipulating the public matching dollar system of the city's Campaign Finance Board. "Mr. Cohen said he and Mr. Rapfogel also funneled some of the illicit money to candidates running for office, asking Mr. Ross to make contributions not only in his name but also in the names of straw donors," The New York Times report added. A press release from the Attorney General's office noted that, "These campaign contributions were made to politicians whom Rapfogel and Cohen believed could help Met Council."

Mere hours after bloggers had noted on August 12 of last year that Mr. Rapfogel's charity had received discretionary funding from former Council Speaker Christine Quinn's slush fund, former Speaker Quinn's mayoral campaign announced that her campaign was returning $25,000 in campaign donations at the center of the William Rapfogel scandal.

The Attorney General's press release of today concluded that, "These convictions are a result of an ongoing investigation by the Attorney General’s Office in conjunction with New York State Comptroller DiNapoli, as part of the Joint Task Force on Public Integrity. The joint investigation by the Attorney General’s and Comptroller’s offices continues."

Let's hope former Speaker Quinn has a good defense attorney.

U.S. Attorney Preet Bharara has said that a "show me the money" culture pervades all of New York government, and many bloggers and government reform activists agree. Last year, the political blogger and YouTube producer Suzannah B. Troy confronted New York Assembly Speaker Sheldon Silver, who has had a decades-long close association with Mr. Rapfogel, and she asked Speaker Silver, "Are you part of the corruption ?"

Bill de Blasio and Bill Rudin Community Betrayal ?

Has Mayor de Blasio turned his back on the community demand for a full-service hospital to replace St. Vincent's ?

Bill Rudin is one of the most corrupt real estate developers in New York City. He is the one, who basically foreclosed on St. Vincent's Hospital. He and his family paid off former Council Speaker Christine Quinn with $30,000 in campaign donations to look the other way. Has Bill Rudin found a way to pay off Mayor Bill de Blasio, too ?

Furthermore, one of the NYC Is Not For Sale commercials that helped to elect Mayor de Blasio focused on the corrupt role of Bill Rudin's campaign donations to former Council Speaker Christine Quinn.

But now that he's been elected, Mayor de Blasio is socializing with the very same corrupt real estate developer whose luxury condo conversion deal he once criticized.

1. Remembering Dr. Brickner. Dr. Philip Brickner, who was chairman of St. Vincent's community medicine department, made house calls and set up a “free clinic” for people in need. This Week in Carolyn Ryan Journalism Realness

Is Carolyn Ryan engaged in a smear campaign against President Barack Obama, or is she only reporting the truth ? Public Editor's "AnonyWatch Review" weighs in.

Before we delve into the latest chapter of Carolyn Ryan's media bias, let's begin by first examining the obsession with "polish" by readers of mainstream journalism. By polish, we mean the fetish with exacting spelling, grammar, syntax, and punctuation on big-name news Web sites.

Earlier today on Facebook, a social media network friend of mine shared a status update in which she made the observation that typographical errors in mainstream media Web sites were distracting, and they degraded her perception of the quality of news being published on said Web sites. This led to a back-and-forth discussion of this topic. At the end, I raised some concerns about how an obsession with typos may distract from the fact that very few journalists (either mainstream or alternative bloggers) very rarely tell the whole truth, that the real quality of journalism may transcend typos and should be judged, instead, on the larger quality of reporting the truth. For example, Anemona Hartocollis, the metropolitan healthcare reporter at The New York Times, gets her copy published in a form that is generally free of copy errors, but her journalism is biased as all get out. Ms. Hartocollis's reporting is emblematic of the corporate agenda in mainstream journalism. Whenever Ms. Hartocollis reports about another community hospital closing in New York City, her reporting only represents the corporate speak of profits-and-losses, and she makes no attempt to humanize the healthcare cuts' impact on real people's lives. Because corporate public relations spin is devoid of any moral obligation, Ms. Hartocollis reduces all her healthcare reporting to be about dollars and cents, siding with Gov. Andrew Cuomo's and his budget axman, Stephen Berger's, desire to make scorched earth cuts to healthcare. As far as Ms. Hartocollis's reporting is concerned, she's never attempted to ever report about the human right to healthcare. Just because Ms. Hartocollis's copy is clean of typos, it doesn't mean it's anymore truthful than a Medicaid Redesign Team press release.

Another example I noted in the back-and-forth on Facebook today was that of a blogger, with whom I'm on the outs. She butchers the presentation of information on her blog like nobody's business. Sometimes, her stream of consciousness blog postings contain incomplete sentences, but more often than not she gets it right when it comes to exposing government and real estate corruption. Her reporting delves deeper than the reporting of some reporters published in The New York Times, for example. Another blogger I know makes big-time typos, too, and sometimes his text "disappears" because of slip-shod copying-and-pasting, but from his blog his readers can learn how to see the corrupt political chess pieces move on big social issues. I acknowledge that it is important to present information, especially journalism, in a way that is accessible to readers, but mainstream journalism, even factoring into account all the waves of "corporate layoffs," still have access to resources like copy editors, interns, other editors, and webmasters that can proof writing after it's been submitted. But, as have been noted time and again, mainstream journalism has come to reflect a corporate agenda that distorts the ability of mainstream journalists to report the whole truth.

Over time, astute readers of political reporting learn that to discover the truth, once must read multiple sources of the same story in order to "average," "balance," and/or "correct" the news. If readers were to solely judge writing on cosmetics, that criteria will short change readers on the truth. Obvious mistakes should be corrected, but some bloggers don't even have editors. So, I'll always defend bloggers before mainstream reporters. But even then, I don't look at polish as being the only criteria for realness.

Carolyn Ryan's use of anonymous sources to report about President Obama's political backlash in the final midterm Congressional elections

Two weeks ago, Washington bureau chief Carolyn Ryan oversaw a report published in The New York Times about Democrats's fears about "their midterm election fortunes amid President Obama’s sinking approval ratings." The article contained a passage with a shady anonymous attribution :

“One Democratic lawmaker, who asked not to be identified, said Mr. Obama was becoming ‘poisonous’ to the party’s candidates. At the same time, Democrats are pressing senior aides to Mr. Obama for help from the political network.”

Public editor Margaret Sullivan chastised Ms. Ryan for the use of an anonymous quote, an issue of recent concern to the public editor and the readers of The New York Times. In her defense, Ms. Ryan pieced together a weak defense in which she denied engaging in an hominem attack on the president. It's difficult to believe that Ms. Ryan, as editor, or Jonathan Martin and Ashley Parker, as the reporters of the subject article, would go out of their way to wrongly roll up responsibility for the flagging fortunes of the national Democratic Party on the president. But the larger political reality that Ms. Ryan and Ms. Sullivan ignored is how the Obama administration silences dissent through political machinations, maneuvering that every high-level elected official uses to control his or her own political narrative. Ms. Ryan was famous for espousing the political narrative propagated by former New York City Council Speaker Christine Quinn when Ms. Ryan used to serve as the metropolitan editor for the newspaper. But now, Ms. Ryan has perhaps learned to challenge power holders, and, by relying on the sentiments of an anonymous source, Ms. Ryan may actually be expanding the political reporting in The New York Times rather than just repeating the official party line of the politicians she's tasked to cover.

No doubt that Ms. Ryan's anonymous sources for the subject article really exist, because many Democrats are plainly fed up by President Obama's corruption scandals involving the National Security Administration, the Monsanto Protection Act, and other political controversies. The public editor was critical of Ms. Ryan's use of an anonymous source, but if Ms. Sullivan would like to further examine why Democrats are afraid to speak out against President Obama, perhaps the editors of The New York Times should examine President Obama's political persecution of liberal advocates and institutions he locks up in the veal pen ? In her further defense, after Ms. Ryan endured so much criticism about her biased reporting that benefitted Ms. Quinn, Ms. Ryan may finally be learning the truth about how journalism really works when one is fully reporting uncomfortable truths about the corrupt political machinations of an elected official. Some sources may not want to go on the record for fear of political retribution. Like a typo hear or their, sometimes journalism realness doesn't always come neatly packaged and wrapped. After President Obama's veal pen gets examined, maybe editors can turn their attention to Ms. Hartocollis's media bias ?

Campaign Finance Board Penalizes NYC Is Not For Sale Super PAC For Campaign Violations

Million-Dollar Anti-Quinn Super PAC Fined Pennies On The Dollar

Ushered in by the corruptive Citizens United Supreme Court decision, a Super PAC that helped end former Council Speaker Christine Quinn's mayoral ambitions was fined $7,050 by the Campaign Finance Board Thursday morning for failing to report $70,000 in expenditures, The New York Daily News reported.

Activists had spent years organizing against former Speaker Quinn for allowing the NYPD to institute a protest parade permit, for over-turning term limits, and for doing nothing to save St. Vincent's Hospital, amongst other betrayals. But then last year, the Super PAC, NYC Is Not For Sale, supplanted the long-term reform activists by launching a million-dollar TV commercial campaign against Speaker Quinn when she was ahead in the polls, rendering the long-term activists to nothing more but useful idiots to the Super PAC. With its very visible negative attack ads on TV, NYC Is Not For Sale took public credit for defeating Speaker Quinn's mayoral campaign, decidedly handing victory in the mayoral race to former Public Advocate Bill de Blasio. In exchange for having received the benefit and support from the Super PAC, the new mayor helped raise money for at least one of coalition members that organized the Super PAC, and the mayor has repeatedly promised to honor the legislative request of the wealthy donors behind the Super PAC.

The fine levied by the Campaign Finance Board represented a financial penalty of about 10 cents on the dollar for the infraction amounts that the Super PAC failed to declare.

That NYC Is Not For Sale flouted city campaign finance regulations revealed how some of the long-term reform activists, who were initially excited for the Super PAC's help to defeat former Speaker Quinn's mayoral campaign, were not fully aware that NYC Is Not For Sale represented trouble.

The Super PAC, NYC Is Not For Sale, supplanted the long-term reform activists by launching a million-dollar TV commercial campaign against Speaker Quinn when she was ahead in the polls, rendering the long-term activists to nothing more but useful idiots to the Super PAC.

Following the Campaign Finance Board's announcement of the fine, reform activists were troubled by the relatively small penalty against the Super PAC. The whole purpose of the activism to defeat former Speaker Quinn was to reform government processes to end corruption and the appearance of corruption. Since the board members of the Campaign Finance Board answer to Mayor Bill de Blasio and the present Council speaker, Melissa Mark-Viverito, it is not known how independent the Campaign Finance Board can be in reviewing violations of groups that have relationships with the administration. Both the mayor and the Council speaker have close ties to the coalition of left-leaning unions, Democratic donors, and animal rights activists that formed NYC Is Not For Sale. NYC Is Not For Sale was advised, in turn, by the political lobbying firm, The Advance Group, which is headed by Scott Levenson. The Advance Group and Mr. Levenson have close ties to the mayor and to the Council speaker. If city campaign finance regulators only assessed this politically-connected Democratic Super PAC with a nominal financial penalty, then reform activists may not reasonably expect just outcomes in respect of complaints about other controversial electioneering work during last year's municipal elections. For example, many of the campaigns and/or Super PAC's advised or administered by The Advance Group have triggered critical press reports questioning possible financial or ethical improprieties.

Notwithstanding, the Campaign Finance Board denied John Liu any public matching dollars in last year's mayoral race over questions of the integrity of his fundraising. Yet, the Campaign Finance Board allowed Councilmember Mark-Viverito to keep all of her public matching dollars, even though she exceeded the spending cap by opening a second campaign finance account with the state Board of Elections in Albany during the same election cycle to fund her speakership race. Separately, the Progressive Caucus of the City Council employed their own lobbyist, Alison Hirsch, in the Council speaker race. However, the Campaign Finance Board has not indicated whether it is comfortable with allowing undeclared or possibly unpaid electioneering work made at the direction of elected officials that take place during an election cycle that subjected those same election officials to spending caps and other public matching dollars restrictions ?

The regulations for campaign finance do not guarantee that every politician is owed a right to keep raising money for post-election leadership races, like the campaign for Council speaker, during the same election cycle where there were spending caps and other matching public dollar restrictions. Every time that politicians raise money, they create opportunities for the undue influence of wealthy campaign donors and lobbyists to have even great influence over our public officials, always at the expense of the mere voter. By allowing Councilmember Mark-Viverito to exceed the spending cap, the Campaign Finance Board has now opened a backdoor to allow any public official to open up campaign accounts with the state Board of Elections that can be used for electioneering purposes that would effectively allow those public officials to game the public matching dollar system through the Campaign Finance Board and still raise more money through a state Board of Elections account. This is a dangerous precedent that the Campaign Finance Board has set. Compounding the concerns of reform activists, the board members of the Campaign Finance Board are now partly answerable to the Councilmember Mark-Viverito, because she has since become the Council speaker as a direct result of questionable electioneering work that falls under the jurisdiction of the Campaign Finance Board.

Judging by the tiny fraction of a fine levied on NYC Is Not For Sale, the Campaign Finance Board is not sufficiently independent to review complaints of campaign finance violations of parties, such as The Advance Group, Mr. Levenson, the animal rights group NY-CLASS, and others, who have as close, if not closer, ties to each of the mayor and the Council speaker than the coalition of left-leaning unions and Democratic donors that formed NYC Is Not For Sale. Indeed, as the Campaign Finance Board continues with its post-election audit, one of the very campaign accounts it must review belongs to the Council speaker, herself.

John Liu sues New York City for blocking public matching campaign funds

"John Liu's campaign did nothing wrong," says lawyer Richard Emery.

John Liu, the former Comptroller for New York City, filed a federal lawsuit today against the City of New York, alleging that he was "denied the opportunity to compete on an even playing field with the other mayoral candidates, and his reputation was irreparably damaged," The New York Post is reporting, adding, that the Campaign Finance Board's decision to deny Mr. Liu $3.8 million in matching public dollars amounted to a “death sentence” to his mayoral campaign.

Mr. Liu's complaint alleges that the Campaign Finance Board unlawfully “crippled” his bid to become the city’s first Asian-American mayor by citing the court convictions of others, even though Mr. Liu himself was never charged with any wrong-doing.

The investigation into Mr. Liu's campaign finances originated in a report published in 2011 by The New York Times at a time when Mr. Liu was attracting serious attention and support for his expected mayoral campaign in 2013. Many activists have alleged that the editors of The New York Times preferred the mayoral candidacy of former City Council Speaker Christine Quinn. After the Campaign Finance Board denied Mr. Liu's public matching funding dollars, former Speaker Quinn received the glowing endorsement of The New York Times' editorial board.

In a further example of the politicization of the Campaign Finance Board, city campaign finance regulators appeared to obsess over Mr. Liu's troubled donations, identified as only 35 out of over 6,300 donations, but city campaign finance regulators did nothing to scrutinize the corruptive influence of super PAC's in the 2013 municipal election.

In a video made last year by The Queens Courier, Mr. Liu described how investigators deceived his campaign workers into accepting tainted donations. Essentially, he was the victim of entrapment.

QUESTIONING THE NEW YORK CITY CAMPAIGN FINANCE BOARD

With John Liu's lawsuit against New York City over conflicted city campaign finance regulators, this makes three federal referrals of elections violations, forcing Mayor de Blasio to lawyer-up, recruit special inside election counsel.

After a wave of federal complaints that have been lodged over electioneering violations in last year's municipal elections, Mayor Bill de Blasio has hired a special legal advisor specializing in election law.

Since Mayor de Blasio and City Council Council Speaker Melissa Mark-Viverito, and/or their political operatives, are entangled in some of these federal complaints, it should come as no surprise that Mayor de Blasio is now maneuvering to use his public office to defend himself against allegations of wrong-doing that took place during the electioneering of last year's municipal elections.

The three federal complaints lodged following last year's municipal elections :

  1. GOP consultant E. O'Brien Murray argued to the State Department that Patrick Gaspard, a former top White House aide with a deep history in Gotham politics, violated the federal Hatch Act by getting involved in Mayor de Blasio's campaign -- and City Councilwoman Melissa Mark-Viverito's subsequent election as speaker -- while representing the U.S. in South Africa. Bill de Blasio, New York Liberals, and the Veal Pen (Updated)

A moment of truth for "liberals" in New York City, as they are corralled into veal pens.

Calves have no choice and would certainly not volunteer to be trapped in veal pens, where cattle factory farmers intend for calves to atrophy into valuable sources of veal, but liberals in New York City, following the lead of liberals in Washington, DC, check into proverbial political veal pens, eager to take their stated, if cramped, place with conscious volition.

The backroom selection of Melissa Mark-Viverito as City Council speaker on January 8 signaled the end, according to The New York Times, of "weeks of bitter, behind-the-scenes jockeying among county political leaders, union officials and others, who tussled over the speakership using such municipal prizes as committee chairs and patronage jobs as bargaining chips," adding that before Ms. Mark-Viverito was unanimously selected, there had been "rumors up until the noontime vote of a possible floor fight." Although the discord was real, it was safest to tussle in private, because none of the backroom fighters carried on their battles outside of the restrictive confines of the veal pen. There were certainly some expressions of exasperation shared with the media, but for the most part, the large activists groups, good government groups, corporations, and even billionaire business leaders publicly kept mum. Hmmmmmmmmmmmm....? Why was that ?

The Mayor Of Magical Thinking

When Mayor Bill de Blasio argued for a special income tax surcharge on the wealthiest New Yorkers, a tax that is certainly needed to help fund a needed expansion of social services, he said that the income tax surcharge was needed because the annual budget dance of proposed service cuts and minimal budget restorations would make pre-kinder students unnecessary political victims of the vicious annual city budget negotiation process. “When the budget cuts come, children are often the first to take the hit. The vulnerable take the hit,” Mayor de Blasio said. Little did he own up to the fact that now that he's in charge at City Hall, it would be Mayor de Blasio, who would throw pre-kinder students under the bus. (It's the mayor, who plays the leading role in the annual budget dance, a sleazy process where the mayor first proposes budget cuts, then the Council speaker pretends to put on a show to restore the budget cuts, and then once the budget passes, the cuts are restored, and the City Council get to look like heroes, even though this process makes it impossible for city agencies and community groups dependent on city grants to adequately plan any kind of medium-term fundraising or long-term budgets.) Even though the mayor is proposing that the high income tax surcharge be dedicated to expanding pre-kinder, the mayor's failed to propose any budgetary mechanism to ensure that the mayor and the City Council don't cut other areas of public education during the annual budget dance. What does earmarking a dedicated revenue stream for pre-kinder mean if funding for kinder remains insecure ? Seems like it's almost double-speak to make such a big deal about ring-fencing the monies from the high income tax surcharge, doesn't it, if it leaves kindergarden students at risk for budget cuts ?

It's precisely because of this sick and twisted annual budget dance that homeless youths have grown wary of the shady municipal budget negotiations : a few brave homeless youths have turned to the Legal Aid Society to make a full, legal demand for the complete resources to finally provide shelter to homeless youths rather than take a risk that the new mayor will force homeless youth shelters to play along with the disingenuous annual budget dance. More on this shortly.

Going into today's speakership selection, Mayor de Blasio had received resounding criticism from the Editorial Boards of The New York Times, The New York Daily News, The New York Post, and even amNew York. An anonymous attack video catching Mayor de Blasio in actual hypocrisy over having criticised former Council Speaker Christine Quinn for having been former Mayor Michael Bloomberg's puppet only to want to install his own puppet in the municipal legislature went viral.

Some bloggers dared to stick their necks out, but they were not joined by any large activist groups. The two good government groups in New York City, for their part, either danced on the graves of the County Bosses or issued toothless Cover-Your-Ass editorials, never mind that the deposition of the County Bosses is only replacing one corrupt political machine for another. But for the most part, given the mixed messaging, folks essentially stayed in the familiar surroundings of the veal pen.

Some Calves Refuse To Take Their Place In The Veal Pens

With the exception of the police reform protest group New Yorkers Against Bratton, the pro bono service agency Legal Aid Society, and the AIDS activist group ACT UP, many activists say that they will keep Mayor de Blasio accountable, but they agree to stay put in their veal pens.

For weeks before the new mayor was inaugurated, a group of activists seeking to fully end stop-and-frisk in New York City came together to protest and reject the appointment of William Bratton as the new NYPD commissioner. Even though the new mayor had campaigned to "end the stop-and-frisk era," the mayor appointed the man widely credited as the architect of stop-and-frisk, Mr. Bratton. The group has been the leading force to keep Mayor de Blasio accountable to his biggest broken campaign promise thus far.

Two days before the new mayor was publicly sworn into office on the steps of City Hall, the Legal Aid Society filed a federal lawsuit against the City of New York, demanding the full resources to provide shelter to homeless youth. They did so, because the New York City budget never before provided the full resources to make shelter available to homeless youth, as required by law, because before the Legal Aid Society stepped forward, all the homeless advocacy groups had remained in their veal pens like good little calves. The Legal Aid Society, tired of the annual budget dance of proposed cuts and minimal restorations, decided that homeless youth shouldn't become political victims to the way City Hall and City Council probably plan to only concentrate on social service groups or causes that hire The Advance Group as their lobbyists.

Like the Legal Aid Society, ACT UP sees the writing on the wall : they'd been patiently waiting in the veal pen for the last few months, stretching back to before the mayoral primary, hoping to get a meeting with the mayor's campaign team, then his transition team, and now his administration team. But the mayor has not deigned to receive AIDS activists, to hear out their demands for a comprehensive city-wide AIDS agenda that begins by appointing a responsive city health commissioner.

When too much time passed, ACT UP broke free of the veal pen, and they protested outside of the mayor's inauguration ceremony.

"By Your Command" : The Calves Know That The Veal Pen Is Guarded From The Inside

When Mayor de Blasio saw that the Legal Aid Society was challenging it on government policy, how did the de Blasio administration respond ? The mayor recruited the top attorney at the Legal Aid Society, Steve Banks, into his administration. To further neutralize the field of outside activism, the de Blasio administration also lured the noted government reformer Lincoln Restler and at least three Spanish language journalists : Maibe Ponet, Roberto Perez, and Erica Gonzalez into the veal pen, just to be sure. Other activist groups have folded, like Queers for Economic Justice and the Brecht Forum, because now that a Democratic mayor has taken office, entrenched political interests don't want to encourage political pressure from the Left. A large foundation that funds non-profit community groups, the North Star Fund, accepted monies from lobbyists loyal to the mayor, Dan Levitan, a vice president at BerlinRosen, told The New York Times. For the few activists and community groups, which do not fold before the mayor's pressures to impose his top-down policies, there are growing numbers of civic leaders, who are being silenced and rendered immobile by the veal pen.

In contrast to the bold leadership of New Yorkers Against Bratton, two former prominent critics of stop-and-frisk have actually turned their backs on the overwhelming community demand to keep the NYPD accountable. After the Bratton appointment was announced, Councilmembers Ydanis Rodriquez and Jumaane Williams said that they supported the controversial appointment, leading to a sense of betrayal among police reform activists. Even the notoriously independent head of the NYCLU, Donna Leiberman, has climbed into the veal pen. Police reforms that the prior police commissioner never adopted remain outstanding, and Ms. Leiberman has not dared to confront the new police commissioner with the NYCLU's recommendations made following the massive 2003 anti-war protest and the 2004 Republic National Convention. Supposedly, the police department enacted some reforms in 2008, but the NYPD's promises were short-lived, because reforms of controversial police tactics were proven to be situational. Witness the police's militaristic response to Occupy Wall Street.

The message being telegraphed to the community is clear : climb into your veal pen and shut up.

Similarly, the LGBT poster child of police entrapment and unconstitutional sexual orientation profiling, Robert Pinter, has disappeared from any public demonstrations condemning the new police commissioner. Prior to the selection of Mr. Bratton, Mr. Pinter had visibly taken part in demonstrations calling for reform of the NYPD, including having once called for the end of stop-and-frisk. Apparently now, Mr. Pinter takes cues on police issues from Bratton-enablers.

Even Yetta Kurland, who I love, because she saved my job for me when they were trying to fire me at Credit Suisse, does not want to encourage ''left leaning friends'' who ''bemoan'' the appointment of the controversial new NYPD commissioner. The message is clear : the new mayor's supporters want to silence critics.

Other activists noted for their work during the primary campaign have also become muted.

The activist-administrator of one very active Twitter account keeping tabs on the corrupt Councilmember Maria del Carmen Arroyo from the Bronx in the time leading up to the municipal primary elections, @arroyowatch now seems to want to stop short of calling for reforms, and only seems content with changes in figurehead politicians without getting to the root of the broken political system.

Separately, in an article in Gay City News, Charles King, the CEO of Housing Works, said of Mayor de Blasio, "I think the community needs to hold his feet to the fire," but Mr. King's done nothing to actually hold the mayor's feet to the fire.

When a corrupt lobbyist tied to both Mayor de Blasio and Speaker Mark-Viverito was exposed for working to defeat LGBT candidates for the City Council, no LGBT civil rights group dared speak out against the politically-connected bigot. Indeed, a corresponding Change.org petition only attracted a few signatures. At today's selection of the new Council speaker, LGBT Councilmembers voted for Ms. Mark-Viverito, even though she had rigorously defended her close working relationship with the bigot lobbyist.

The LGBT community fought so hard to come out of the closet only to, out of political expediency, climb into the veal pen.

Animal rights activists used to carry the banner against the corrupt record of Speaker Quinn, but now they are quick to denounce any activist who tries to hold the de Blasio-Mark-Viverito administration accountable for delivering reforms.

Even powerful business leaders, seeking to do billions of dollars worth of "business" with New York City, have obediently kept quiet, "saying they are worried about the consequences of offending the mayor," wrote two City Hall reporters for The New York Times.

The prospect of Speaker Mark-Viverito, who was an organiser with the 1199SEIU, the healthcare union that backed Mr. de Blasio's winning mayoral campaign, serving hand-in-hand with the mayor has been invoked by big business interests in the manner of a menacing scare tactic : the rich are going to leave New York City in droves, business are going to close and move to Florida, and the de Blasio-Mark-Viverito administration is going to choke off enterprising new businesses from forming in an era of leftist over-regulation, like a planned nominal expansion of the paid sick leave law. Ms. Mark-Viverito also owes her speakership to the interventions of Mayor de Blasio. When some activists criticised the mayor's violation of separation of powers to advance Ms. Mark-Viverito's speakership, they weren't invoking "checks and balances" to help prop up a big business agenda, as some claim, but to, instead, question Speaker Mark-Viverito's resolution to challenge the mayor on controversial neoliberal moves, like the Bratton appointment or the decision to embrace a close relationship with real estate developers. The new mayor has a failed record of fighting for affordable housing in connection with large, controversial zone-busting development deals, like at the Atlantic Yards project in Brooklyn. The tragic irony is that for everybody supporting a Democratic take-over of both Gracie Mansion and City Council, Speaker Mark-Viverito may not have the courage to openly challenge the mayor to deliver a truly progressive reform agenda that would include letting the calves know that they could very easily walk out, free from the confines of the veal pen.
